The firm primarily
represents mortgage lenders, investors, servicers and others
in the following areas of practice:
Bankruptcy
|
The firm handles a broad spectrum of creditor bankruptcy
work. It provides a full range of legal services in consumer
bankruptcies (chapter 7, 12 and 13), including attending
meetings of creditors, preparing and filing proofs of claim,
defending objections to proofs of claim, evaluating plans,
filing and defending objections to confirmation of bankruptcy
plans (where appropriate) and pursuing relief from the automatic
stay and motions for dismissal.
In addition, the firm has considerable experience in creditor
representation in chapter 11 proceedings. It has represented
real property lenders and chattel mortgage (personal property)
lenders, as well as unsecured creditors, in chapter 11 cases.

Collections
|
The firm represents creditors in both consumer and commercial
collection matters.
|
Eviction
|
Evictions following completed foreclosure sales, as well
as failure to pay rent or lease termination situations, are
handled by the firm for both institutional and individual
clients.

Excess Sale Proceeds Recovery
|
Representation in connection with the recovery of excess
sale proceeds from foreclosure sales conducted by the firm
and by other trustees is provided by the firm for institutional
and individual clients.

Foreclosure
|
The firm handles both residential and commercial foreclosure
matters for both institutional and individual clients. In
addition to “routine” judicial and non-judicial
foreclosure work, the firm is experienced in dealing with
contested foreclosure cases, including those requiring the
appointment of a receiver.

Litigation
|
The firm is regularly engaged to represent its clients
in general litigation matters. It has experience in cases
involving real property issues (e.g., partition actions,
deficiency claims, title insurance issues, escrow liability,
boundary disputes, eminent domain, adverse possession and
prescriptive easement cases), lender liability issues, breach
of contract claims, breach of warranty claims and negligence
claims.

Loss Mitigation
|
The firm provides experienced loss mitigation representation for its clients. Included in the forms of loss
mitigation options are deeds in lieu of foreclosure, forbearance
or workout agreements and loan modifications.

Reconveyances and Releases
|
The firm provides reconveyance and lien release services
for a number of mortgage servicers as well as reconveyance
contractors.
|
REO Matters & Closings
|
Working in conjunction with its title subsidiary, eTitle
Insurance Agency, the firm provides complete representation
of lenders in connection with REO properties. In addition
to the eviction and title clearing services described above,
the firm coordinates closings on REO property sales through
its subsidiary.

Replevin
|
Replevin cases (recovery of personal property securing
an obligation) are handled by the firm for a variety of
clients, including mortgage services, credit unions, vehicle
financing companies, retail merchants and individual investors.

Title Resolution
|
The firm’s experience in handling real property title
issues includes title curative work in conjunction with
foreclosure proceedings, title defense for insured property
owners and lenders, prosecuting and defending quiet title
proceedings and title insurance claims litigation.
